Terms of Service
Welcome to Manila Web. We are a small web design studio based in Metro Manila, Philippines, run by Daniel. We design and build websites for local small businesses, and we like to keep things simple and clear, including this page.
These Terms of Service explain how we work together, what you can expect from us, and what we ask of you. Please read them. By contacting us, requesting a free preview, or hiring us to build your site, you agree to these terms. If anything here is unclear, just email us at hello@metromanilawebsites.com and we will be happy to explain.
1. Acceptance of these terms
By using our website at metromanilawebsites.com, submitting our contact or free preview form, requesting a preview, or engaging us to design and build a website, you agree to be bound by these Terms of Service. If you are agreeing on behalf of a business, you confirm that you are authorized to do so.
If you do not agree with these terms, please do not use our website or our services. We may ask you to confirm your agreement in writing, for example by email or message, before we begin paid work.
2. Who we are and what we do
Manila Web is a web design studio operated as a sole proprietorship by Daniel in Metro Manila, Philippines. We design and build websites for local small businesses. You can reach us at:
- Email: hello@metromanilawebsites.com
- Phone and WhatsApp: +63 966 990 2045
- Website: metromanilawebsites.com
Our service is to design, build, and launch a website for your business. Most sites go live in about 7 days once we have what we need from you. We work with you through a clear, friendly process described below.
3. The free preview
We offer a free website preview so you can see a real version of your site before you pay anything. Here is how it works:
- The preview is genuinely free and comes with no obligation. You are not committing to buy anything by requesting one.
- The preview is a sample of what we can build. Until you pay in full, Manila Web keeps full ownership of the preview, its design, code, and content that we created.
- You may not copy, publish, host, or reuse the preview, in whole or in part, unless and until you have paid for a package.
- Previews are temporary. We may take a preview offline at any time, and we may remove inactive previews to free up resources.
If you decide to move forward, we turn the preview into your real, owned website once payment is complete.
4. Pricing and payment
Our website packages are one-time fees in Philippine pesos:
- Launch: P18,000
- Signature: P25,000 (our most popular package)
- Commerce: P45,000
We also offer an optional care plan at P4,000 per month, which you can cancel anytime. It is never required to use your website.
Unless we agree otherwise in writing, package fees are due before your site goes live, and we will confirm the exact payment schedule and accepted payment methods with you before we start the build. Prices shown on our website may change over time, but the price we quote and agree with you for your project will be honored for that project. Fees are exclusive of any third-party costs you choose to pay directly, such as your domain name or premium add-ons, unless we state otherwise.
5. The project process and what you provide
Building a great site is a team effort. To keep your project on track and to hit our typical 7-day timeline, we ask that you provide:
- Your content, such as the text, business details, and any specific information you want on the site.
- Your photos, logo, and any brand materials you want us to use, along with confirmation that you have the right to use them.
- Timely feedback and approvals at each step, so we can keep moving.
If we are waiting on content, materials, or feedback from you, your timeline may shift. We are not responsible for delays caused by late or incomplete information from your side. You are responsible for making sure the content and materials you give us are accurate and do not infringe anyone else's rights.
6. Intellectual property and ownership
Once you have paid your package fee in full, you own the finished website we deliver to you, including its design and content as delivered. Until full payment is received, all design work, code, and preview materials remain the property of Manila Web.
You keep ownership of the materials you provide to us, such as your logo, photos, and text. By giving them to us, you allow us to use them to build and run your site.
Some parts of a website may rely on third-party tools, fonts, plugins, or open-source code that come with their own licenses. Those remain under their own terms and are not transferred to you as your property.
Unless you ask us not to, we may showcase the work we did for you in our portfolio and marketing, for example a screenshot or a link to your live site. If you would prefer we not feature your project, just let us know and we will respect that.
7. Revisions and changes
We want you to be happy with your site, so reasonable revisions are part of the process while we build. We will agree on the scope of your project up front so we both know what is included.
Requests that go beyond the agreed scope, such as adding new pages, new features, a redesign after approval, or significant new content, are considered additional work. We will let you know in advance if a request falls outside the agreed scope, and we will quote any extra cost or time before doing the work. We will never add charges without telling you first.
8. The care plan
Our optional care plan is P4,000 per month and helps keep your website healthy after launch, for example with updates and small ongoing support. It is completely optional, and your website is fully yours whether or not you take it.
There is no lock-in. You can cancel the care plan anytime, and it will stop at the end of the current billing period. Monthly fees already paid are not refundable for the period they cover. If you cancel, you keep your website, but ongoing care tasks covered by the plan will stop.
9. Disclaimers and no guarantee of results
We build your website with care and to a professional standard, but we cannot promise specific business outcomes. In particular, we do not guarantee any specific search engine rankings, amount of traffic, number of leads, sales, or revenue. These depend on many factors outside our control, including search engines, advertising platforms, your market, and how the site is used over time.
Our services and any preview are provided on an as-is and as-available basis. While we work to deliver a reliable, working website, we do not guarantee that it will be uninterrupted or completely error-free at all times, especially where third-party services are involved.
10. Limitation of liability
To the fullest extent allowed by Philippine law, Manila Web will not be liable for any indirect, incidental, or consequential losses, including lost profits, lost revenue, lost data, or loss of business opportunity, arising from your use of our website or our services.
To the extent we are found liable for any claim relating to a project, our total liability will not exceed the total amount you actually paid us for that project. Nothing in these terms limits any liability that cannot be limited or excluded under Philippine law.
11. Third-party services
Your website may rely on services provided by other companies, such as web hosting and content delivery, domain name registration, payment gateways, email delivery, and analytics or advertising tools. These services are run by those third parties under their own terms and pricing.
We are not responsible for the performance, availability, pricing changes, or actions of these third-party providers. Where a third-party service charges you directly, for example a domain renewal or a payment gateway fee, those charges are your responsibility. We are happy to help you understand and set up these services, but the relationship and any account is between you and the provider.
12. Termination
You may decide to stop a project at any time before it is completed. If you do, any fees already paid cover the work done up to that point and are generally not refundable, unless we agree otherwise. Because ownership transfers only on full payment, unpaid work and previews remain ours.
We may also pause or end a project if fees are not paid as agreed, if we cannot get the content or cooperation we need to continue, or if the work would require us to do something unlawful or that we are not comfortable with. We will always try to communicate clearly with you before taking such a step.
13. Governing law and venue
These Terms of Service are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law rules. Any dispute that we cannot resolve amicably will be subject to the jurisdiction of the proper courts of the Philippines.
We would always prefer to sort out any concern directly and in good faith, so please reach out to us first so we can try to make things right.
14. Changes to these terms
We may update these Terms of Service from time to time, for example if our services or the law change. When we do, we will update the date shown on this page. The version posted here is the current one, and it applies to your use of our website and services going forward.
For projects already agreed and in progress, the terms we agreed with you at the start continue to apply to that project unless we both agree to a change.
